Definitions

 
 
 
  • Participant(s) – A Rexel Electrical Supplies customer who is participating in the Rexel Rewards Programme.
  • Promotion or Programme – The Rexel Rewards Programme.
  • Promoter – Rexel Electrical Supplies, a division of Redeal Ltd.
  • Points – Rexel Reward Points.
  • Programme Account – The programme account opened for a Participant for the sole purpose of accruing points.
  • Trading Account – The trading account held with Rexel Electrical Supplies (The Promoter).
  • Programme Website – www.rexelrewards.co.nz
  • EMC – The Extra Mile Company who run the programme on behalf of the Promoter.
  • The singular includes the plural and vice versa.
 
 

Acceptance of Terms and Conditions

  • The presentation of a signed Registration Form for Rexel rewards Programme or the Registration through the Rexel Rewards website constitutes acceptance to be bound to all terms and conditions that apply to this programme.
  • A participant agrees that these terms and conditions apply to any points they earn on this programme.
  • Only individuals may be Participants of the Programme. Those individuals are deemed either directors of the Company which holds the trading account with Rexel or individuals who have been given written authority to be a recipient of points from a director of that trading account.
  • Terms and conditions may be amended from time to time without notice as may be deemed appropriate at the sole discretion of the Promoter.

Eligibility

  • Participation in the Programme is by invitation only and subject to approval of the Promoter.
  • Membership to the Programme will commence from the time the registration has been accepted by the Promoter.
  • Rexel Rewards Programme does not constitute an offer capable of acceptance by any person resulting in a contract or any other legally binding agreement.
  • A Participant must hold an active trading account with the Promoter and meet the Promoters standard terms and conditions for that account. Failure by the Participant to operate their trading account within acceptable terms may, at the sole discretion of the Promoter, result in forfeiture of all accrued points.

Programme Dates

  • The Rexel Rewards Programme began on 1st April 2005.
  • The Programme will operate on a yearly validity and continuation of the Participant’s involvement in the Programme will be subject to re-registration each year.
  • Points will be accrued from the date the registration has been accepted by the Promoter and run through to the next yearly validity date of 1st April.

Earning Points


  • Participants in the Programme will accrue points at a rate of 20 points for every $100.00 net spent on purchase of goods through the trading account.

  • X-factor points are earned by purchasing key suppliers products
  • Regular points are earned by purchasing from non-key suppliers.
  • Online Auction Points are earned by purchasing product as highlighted in the Hotwire publication and by answering survey questions online.
  • Points accrued in the Programme are the property of the Participant and are not transferable to any other person, entity or programme account unless agreed in writing by the Promoter.
  • Adjustments will be made in the points accrued in the Programme if there are any credits from returned goods or billing disputes.
  • The Promoter will from time to time at their sole discretion run promotional activity through the Trading Account which will allow Participants to obtain bonus points called Xcelerator Points.
  • Points accrued in the Programme have no monetary value and cannot be redeemed for cash.
  • The promoter at his sole discretion may alter future points rations. This will relate to the number of points accrued against the net dollars spent.
  • A new participant must earn a minimum of 2,000 points (equivalent to $10k net spend) before they can redeem points for rewards. Failure to earn this minimum points value in the first year will mean that any points earned to that 1 year anniversary become the property of the Promoter, furthermore, the participant’s participation in Rexel rewards may be concluded after this first year as per Section 8.1.

Points Expiry

  • Points accrued in the Programme from 1st April 2005 will have an expiry date of three (3) years. Failure to use the accrued points within this time frame will result in the points becoming null and void and the property of the Promoter.
  • Online Auction Points are issued in relation to each issue of the Hotwire publication and are valid only in respect of the Auction promoted in each such publication. Following the conclusion of each Online Auction the Auction points issued will be considered as expired and not valid for future Online Auctions.

  • Any points which are not used by a Participant in claiming a reward within 3 years after the end of the month in which the points were credited to the Programme account will expire and will be deducted from the points balance in that Programme account.
  • If a participant closes their trading account with the Promoter they will have 30 days in which to use their points after the account is closed. Points still remaining in the programme account after the 30-day period will become the property of the Promoter.
  • If a Participant maintains a trading account but the account becomes “inactive” for a period of three months then the Participant will be required to use their points within 30 days following the 3 months period. Points still remaining in the programme account after the 30-day period will become the property of the Promoter.

Rewards and Rewards Redemption

  • The rewards available in the Programme at any time are set out on the Programme website (www.rexelrewards.co.nz). These rewards may vary from time to time as product models change and travel packages come available or expire.
  • All rewards are subject to availability and the Promoter at his sole discretion may substitute or offer similar products to the same value when necessary.
  • A participant may claim a reward if they have sufficient points at the time of the claim and their trading account meets the Promoters Standard Terms and Conditions.
  • Please allow up to 28 days for processing and delivery of rewards.

  • No buy-in or part payment from a Participant for rewards will be permitted unless prior approval has been cleared by the Promoter.
  • All rewards are subject to the specific conditions on which the provider of the reward makes the reward available. If there is any inconsistency between them and these Terms and Conditions, the specific conditions prevail.
  • Any dispute concerning rewards received under the Programme will be settled between the Participants and the supply merchant. The Promoter and its agent (EMC) will take no responsibility for resolving such disputes or for the dispute itself.
  • The Promoter and its agent (EMC) are not responsible for lost or stolen rewards, vouchers or tickets including during the course of delivery.
  • The Promoter and its agent (EMC) are not responsible if you cannot claim or redeem a reward for reasons beyond the Promoter or its Agent’s control including the failure of a reward supplied to honour its obligations for any reason. However in these circumstances where a participants points have not been redeemed, they may claim an alternative available reward.
  • Rewards and redeemed rewards are not exchanged for other rewards, refundable, replaceable or transferable for cash or credit under any circumstances. Nor can redemptions be cancelled or changed once they have been made.
  • No cash payment will be made for any unused points.
  • Points may be used to make partial or full payment of the Promoters trading account. No penalty or surcharge will apply.
  • Participants requesting rewards that are not available through the Promoters Agent (EMC) may do so only after they have approval from the Promoter. A surcharge of points will apply to the value of 15% of the redemption cost. The Promoter at his sole discretion may change or alter the value of this surcharge.

  • The number of points used for a reward claim will be deducted from the points balance of the Participant’s Programme account with the oldest points being deducted first.
  • Some rewards may incur delivery charges over and above the point’s values shown. Where possible the Participant will be advised of the extra charges prior to extra points being deducted.
  • Merchandise Rewards are subject to manufacturers guarantees/ warranty and may only be returned if damaged or faulty through the Promoters Agent.
  • All travel rewards are subject to availability and normal airline conditions of carriage.
  • Due to suppliers’ Christmas break any rewards you wish to have delivered before Christmas must be requested prior to 22 November. There will be no reward deliveries between 15 December and 15 January each year.

Cancellation of Participation and Programme Termination

The Promoter may terminate a Participants ability to participate in the Programme without notice for any reason including, without limitation if the Participant:

  • Fails to comply with these Programme Terms and conditions.
  • Abuses any privilege accorded to the participants under the Programme.
  • Does not earn points for a continuous period of three months.
  • Supplies any misleading information or makes any misrepresentations to the Promoter or his Agent in connection with the Programme.
  • Becomes deceased.

If the Company becomes insolvent, goes into liquidation or is sold.

  • A Participant may terminate their participation in the Programme at any time by giving written notice to the Promoter.
  • The Promoter may discontinue the Programme at any time at their discretion without prior notice. The Promoter will not be liable for the suspension or termination of the Programme on any programme account whatsoever including (without Limitation) for any points balance in a Participants account at the time of suspension or termination. At the completion of the Programme any unused points become the property of the Promoter.

Privacy and Information Collected

A complete Privacy and Collection Statement can be viewed on the Programme website (www.rexelrewards.co.nz) the first time participants “Log in”. This statement sets out policies on management of Participants personal details. In accordance with the Privacy Act, Participants can access personal information about them held by the Promoter and its Agent (EMC) and advice if they believe it is inaccurate incomplete or out of date by contacting the Promoter.

Participants authorise the Promoter and its Agent (EMC) to seek access to, collect and use information about them for the purposes of marketing, planning development and administration of the Programme.

General

  • Participants are solely responsible for any Government Tax, duty or other charge imposed by law in respect of the Programme, the Participants involvement in the Programme, any points acquired or redeemed or any other transaction within the Programme.
  • All questions or disputes regarding eligibility for the Programme or the eligibility of Points for Accrual or redemption of rewards will be resolved by the Promoter at its sole discretion. Any such questions or disputes must be bought to the Promoters attention in writing within 3 months.

Disclaimers

The Promoter and its Agent:

  • Make no express or implied warranty or representation in connection with the rewards (including with respect to type, quality, and standard of fitness for any purpose).
  • Are not liable for any loss Participants suffer (including consequential loss) arising in connection with rewards (including a failure to provide a reward, its loss, theft or destruction).
  • Are not liable for any loss Participants suffer (including consequential loss) in connection with the Promoter or its Agents negligence or their breaching a term, warranty or condition in relation to the Programme.

Where the Promoter and its Agents are liable for a breach of these Terms and Conditions, then their liability will exclude an indirect or consequential loss a Participant may suffer. The Promoter and its Agents liability is limited to:

  • Where the reward constitutes goods, replacement or repayment of the goods or payment of the cost of replacing or repairing the goods.
  • Where the reward constitutes a service, supplying the service again or payment of the cost of having the service supplied again.

Rewards may only be returned if damaged during delivery or faulty. If a reward is covered by a manufacturer’s warranty and requires service, a Participant must contact the manufacturer named in the warranty information.

The Promoter and its Agents failure to enforce a term of these Terms and Conditions does not mean a waiver of them.

Changes to These Terms and Conditions

The Promoter may change these terms and conditions at any time. Participants agree that they are bound by any change when they first register onto the Programme.

Changes may include (but not be limited to) changes to:

  • The rewards available
  • The way Participants earn points
  • The way Participants can redeem points
  • The number of points required to obtain a reward
  • The number of points awarded and point conversion rates

Any of these changes may be made even if they affect points participants have already earned.
